This visa is for those who wish to join their spouse/fiancé (who must be either a UK citizen or a foreign citizen with Indefinite leave to remain or an EU national with settled or pre-settled status in the UK) in the United Kingdom with the purpose of making the United Kingdom their permanent home.
The applicant would need to show that they are in a long-term committed relationship either legally married or living together in a relationship akin to marriage for at least two years together with a minimum English language requirement at level A1.
The applicant and the applicant sponsor in the UK would also need to satisfy the financial requirement which is to demonstrate that the UK sponsor is in permanent employment earning at least £18,600 per year. If the UK sponsor is also seeking entry clearance for any dependent children at the same time as the spouse then additional earning levels are required.
The fiance visa has the same English language and financial requirement however as the parties are not married the applicant and sponsor must show that they intend to get married soon.
Normally a grant of entry clearance or leave to remain in the spouse category would be granted for an initial period of 2.5 years which is extendable and would permit the applicant to work on arrival into the UK.
